- Billing and Payment
Internet2 will invoice the RHCPP Participant for its Internet2 Network Use Fee (“Fee”) upon RHCPP Participant’s acceptance of these Terms of Use. Payment is due upon receipt of Internet2 invoice. The Fee is non-refundable. Payment grants RHCPP Participant the right to connect to the Internet2 Network for a period of one (1) year upon Internet2's receipt of RHCPP Participant's payment and confirmation of RHCPP Participant’s connection arrangements. For purposes of invoicing, the start of RHCPP Participant’s one (1) year connection period will be set to the nearest first day of the month following approval of the connection (“Start Date”). Authorization to use the Internet2 Network, through a Connector, will be established upon: a) Internet2's receipt of payment from RHCPP Participant of the RHCPP Participant's portion of the Fee; b) Internet2's receipt from RHCPP Participant of the payment voucher generated from the Universal Service Administrative Company (USAC) website; and c) Internet2's receipt of written confirmation from Connector of RHCPP Participant's connection arrangements through Connector.

- Term of Connection
Internet2 offers two options for the Term (the Initial Term and any Renewal Terms) of RHCPP Participant’s connection to the Internet2 Network. These options are consistent with USAC preferences as documented in notes from a USAC conference call on September 17, 2009 (notes available upon request to fcc-rhcp-application@internet2.edu). Please select one of the two following options. Internet2 staff will confirm your selection in a subsequent email communication.
Option 1: RHCPP Participant requests a five (5)-year connection to the Internet2 Network beginning on Start Date and automatically renewing on anniversary of Start Date (each a “Renewal Date”) for each year within the five-year contract term. RHCPP Participant will be invoiced $25,000 per year upon the Renewal Date for a total of $125,000 in annual payments over a five (5)-year connection term.
The Parties' obligations as set forth in Section I, above, commence upon the Start Date, and shall continue in effect for a period of one (1) year from Start Date ("Initial Term") and shall automatically renew on an annual basis for four (4) additional consecutive one (1) year terms (each, a “Renewal Term”) unless otherwise terminated in accordance with these Terms of Use or cancelled by either Party upon written notice to the other Party at least ninety (90) days prior to the end of the then-current Term. Internet2 shall not refund any Fee or any other payment to RHCPP Participant in the event of termination for convenience.
Option 2: RHCPP Participant requests a one (1) year term of connection to the Internet2 Network beginning on Start Date (“Initial Term”) with the option to renew for up to four (4) additional one (1) year terms on the anniversary of Start Date (each a “Renewal Date”) to a maximum of five (5) one (1) year terms (each a “Renewal Term”). Notice of RHCPP Participant’s intent to renew for subsequent terms shall be submitted to Internet2 in writing at least ninety (90) days prior to the end of the then-current Term. RHCPP Participant will be invoiced $25,000 per year upon the Renewal Date.
The Parties' obligations as set forth in Section I, above, commence upon the Start Date of connection, and shall continue in effect during the Initial Term unless otherwise terminated in accordance with these Terms of Use. At the end of the Initial Term, upon the Parties’ mutual written agreement, these Terms of Use shall renew on annual basis for each subsequent Renewal Term for up to four (4) additional one (1) year terms unless otherwise terminated in accordance with these Terms of Use or cancelled by either Party upon written notice to the other Party at least ninety (90) days prior to the end of the then-current Term. Internet2 shall not refund any Fee or any other payment to RHCPP Participant in the event of termination for convenience.

- Internet2 Network Usage
RHCPP Participants may use their Internet2
Network connection for any lawful purpose as allowed under the Internet2 Network
Acceptable Use Policy (“AUP”).
The Internet2 Network is provided on an as is, as available basis, including unscheduled outages, with all faults, and without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement. No statement, oral or written, given by Internet2, any of its employees, or any other person will create a warranty, nor may any Internet2 Network Connector, Internet2 Network Participant, Internet2 Network RHCPP Participant, or other person rely on any such statement for any purpose.
- Acceptance of Terms
